New Hope Film Festival Terms of Use

New Hope Film Festival®️, a private arts organization, was founded by D. F. Whipple on January 1, 2009 with a mission to discover and nurture talented filmmakers who have been overlooked and/or under-appreciated by the film industry. This website at www.newhopefilmfestival.com is maintained by the New Hope Film Festival (NHFF) in order to promote films accepted by NHFF and to educate the public about our work. We hope you will join us at our events and/or take advantage of our online offerings.

Our website allows full public access on a complimentary basis with the understanding that visitors to our website will not infringe our copyright and trademark rights by using our content in unauthorized ways, such as commercial uses without our consent, or make any use of our trademark New Hope Film Festival®️ in a manner that falsely implies we sponsor, endorse or are affiliated with an organization.

When using our website and social media platforms, please be on your best, most courteous, upbeat and respectful behavior. We reserve the right to monitor and remove comments, ban users from our web pages, remove films previously invited or accepted, revoke awards and block email addresses if we believe, at our sole discretion, a user has behaved in a spiteful, unprofessional, harmful or hostile manner.

Although we try to present complete and factual information, we cannot guarantee the accuracy of information, and the website is available to users on an “as is” basis without any warranty or representations.

We comply with the Digital Millennium Copyright Act (“DMCA”) with regard to third-party content and user comments under United States copyright law. You must send us contact information such as an email address, physical address or telephone number so we and the providers of any content can contact you about your complaint.

Description

The text of your complaint must thoroughly describe the copyrighted content you are seeking to protect. Please provide any locating information such as URLs. If multiple copyrighted works are included in a single complaint, the law allows a representative list of such works.

Statements

You must agree to and include the following statements: 1) “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law” and 2) The information in this notification is accurate, and under penalty of perjury, I am the owner, or an agent authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.”

Signature

Complete complaints must have the physical or electronic signature of the copyright owner or a representative authorized to act on their behalf. To meet this requirement, you may enter your full legal name (a first and last name, not a company name) to act as your signature on the complaint.

Prior to making a claim under the DMCA, you must consider whether our use of the work is covered under the fair use area of law in parallel with United States Constitution First Amendment protections. The DMCA is not designed or intended to infringe upon freedom of expression.

Any content accessed via links to third party websites is entirely the responsibility of the owners and administrators of those sites. The creators of third party content included on our website, which may include audiovisual works, written works and photographs, are entirely responsible for the content of their own works, and by visiting our website you agree to release and hold us harmless from and against any claims whatsoever, including copyright, trademark, right of publicity, defamation, invasion of privacy or libel in relation to the content of any third party works available on our website regardless of whether the content was posted by us. This unlimited release applied to our officers, directors, employees, agents, licensees, and assigns. This summary of our terms of use does not limit out right to invoke any and all other applicable provisions, laws and regulations available to us at any time. Our corporate office is located in New Hope, Pennsylvania, and the laws of the state of Pennsylvania shall govern this agreement and provide exclusive venue and jurisdiction of any disputes.

New Hope Film Festival Privacy Policy

This privacy policy outlines how the New Hope Film Festival collects and uses personal information through anyone’s use of our websites and third party platforms, including our ticketing platform and email service provider.

We normally do not collect and store personal information, but we will at times archive emails and we have online access to some personal data, as detailed below, that is collected by our third party ticketing vendors during the purchase of online features including, but not limited to, Festival tickets, passes, vouchers, subscriptions, members and donations as applicable. We do not maintain email address for the purpose of solicitations and email blasts except where users opt-in, such as through sponsorships and memberships, or when filmmakers whose works have been accepted as an Official Selection of the New Hope Film Festival may reasonably need, expect and/or welcome communications from us.

Our third party ticketing vendor gives us access to the following information:

  1. Personal Information including your Last Name, First Name and Organization
  2. Your email address
  3. Your Purchase History, including but not limited to Order Number, Event, Venue and Donation
  4. Aggregated Data not considered personal data under the law.

Our email service provides us with any email addresses and names you transmit to us and we may store such emails and names in a folder for future reference in case we ever need to contact you. The New Hope Film Festival does not sell or rent your personal information to any other organization.

Some of our third party vendor relationships are with organizations based outside the European Economic Area (EEA), so their processing of your personal data entails a transfer of data outside the EEA. The New Hope Film Festival does not transfer your data to other organizations, and we only allow vendors to collect your data if we have determined they are taking proper precautions to safeguard your personal information. Our vendors are domiciles and governed by countries deemed to provide an adequate level of protection for personal data by the European Commission.

Under certain circumstances, you have the following legal rights related to your personal data. If you contact us for the following purposes, we may need to request specific information about you in order to confirm your identity and ensure you have the right to access your data.

  1. You may request access to your personal data in order to check whether we are lawfully storing and processing it.
  2. You may request correction of your personal data.
  3. You may ask us to delete or remove personal data where there is no good reason for us to continue to store or process it.
